The Services, including all software, source code, designs, workflows, documentation, algorithms, models, trademarks, logos, and proprietary technology, are owned by Smmartt or its licensors and are protected by intellectual property laws.

Informal Resolution
Before commencing arbitration, the parties agree to attempt to resolve disputes through good-faith negotiations for at least thirty (30) days after written notice of the dispute.
Binding Arbitration
Any dispute arising from or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, REPRESENTATIVE ACTION, COLLECTIVE ACTION, OR CLASS ARBITRATION.
Exceptions
Claims relating to intellectual property rights, injunctive relief, or matters eligible for small claims court may be brought in a court of competent jurisdiction.
These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Subject to the arbitration provisions above, any legal proceeding shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
